Why does Orchard Estates have two sections with two property owners associations?
Orchard Estates was developed in 1987 by Old North Salem Development Group, Inc. In 1991, a different company, Orchard Development Corporation, began development on Orchard Estates, Section Two. In 1992, Sections 1 and 2 merged to become one homeowners association, known as Orchard Estates Property Owners Association, Inc. The neighborhood’s remaining undeveloped property was purchased by National Property Development, which in 1994 created a separate homeowners association known as Orchard Estates Section 3 Property Owners Association.
Why haven’t the two sections merged?
Presidents of both associations have approached the homeowners who live in Sections 1 and 2 and they have declined the offer to merge associations.
What are the responsibilities of the two sections?
Sections 1 and 2 are responsible for the sign at the entrance of the neighborhood and for maintaining the medians on Orchard Boulevard.
Section 3 is responsible for maintenance of the pond and dam.
Why are the two associations’ assessments different?
Sections 1 and 2 have a lower assessment because their liability insurance premiums are lower than Section 3’s premiums. In addition, they do not have the maintenance responsibilities on the pond and dam that Section 3 has.
Why don’t we improve the area around the pond?
The pond was built to contain storm water run-off. The area around the pond has many fallen trees and lots of overgrowth, and it would be very costly to clear up all of the debris. Also, our association’s liability insurance premium would increase if there was more activity around the pond.
Why is our association responsible for the pond and dam?
When Orchard Estates Section Three was platted, there was an agreement that OES3’s property owners association would be responsible for maintaining the dam.
How are the two sections’ covenants different?
The covenants are very similar in content, including the exclusion of fences except in the case of an in-ground pool. Section 1 and 2’s covenants allows mini barns with approval. Section 3’s covenants do not allow mini barns.
Are the houses at the ends of Apple Blossom and MacIntosh part of OES3POA?
They are not part of our association. Their properties were sold to private owners apart from the association. They have their own association, along with the properties at the ends of Apple Street and Apple Way in Sections 1 & 2.
